The accused was charged with care or control while impaired. He was found sitting in the driver’s seat of his car in a drunken condition.
He was taken to the police station and gave the police two breathalyzer reading of 300 mgs of alcohol in 100 mgs of blood. The breathalyzer reading was more than 3 times the legal limit of 80 milligrams.
